Welcome to Kahuwa! These Terms of Service ("Terms") govern your access to and use of the Kahuwa website ([https://kahuwa.in](https://kahuwa.in)), mobile applications, APIs, and associated services (collectively, the "Service"). By accessing or using Kahuwa, you agree to be bound by these Terms.

1. Eligibility & Account Registration

You must be at least 13 years old to use Kahuwa. If you are between 13 and 18, you may use the Service only with the consent of a parent or legal guardian.

You agree to provide accurate, current, and complete information during registration and keep your account information up to date.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must immediately notify Kahuwa of any unauthorized use of your account or security breach at [email protected].

2. User Content & Licensing

Ownership: You retain full ownership of the original video content, sounds, captions, and media you upload to Kahuwa.

License to Kahuwa: By uploading content, you grant Kahuwa a worldwide, non-exclusive, royalty-free, transferable license to host, transcode, store, distribute, cache, publicly perform, display, and create derivative thumbnails/previews solely for the purpose of operating and promoting the Service.

Content Responsibility: You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions (including music synchronization rights) for any content you upload.

3. Prohibited Conduct

When using Kahuwa, you agree NOT to:

Post, stream, or distribute content that is illegal, defamatory, sexually explicit, harmful to minors, violent, abusive, threatening, hateful, or discriminatory.

Upload content that infringes any patent, trademark, copyright, trade secret, or other proprietary right of any third party.

Use automated scripts, bots, scrapers, crawlers, or engagement-inflation software to view, like, comment, or manipulate metrics.

Engage in artificial view inflation, self-clicking ads, click farms, or deceptive monetization practices.

Impersonate any person, brand, or entity, or falsely state or misrepresent affiliation with any entity.

Attempt to decompile, reverse engineer, bypass security controls, or probe platform vulnerabilities.

Sell, trade, or transfer your Kahuwa account or username without express written permission.

4. Creator Monetization Program

Eligible creators may apply to join the Kahuwa Creator Monetization Program upon meeting platform criteria (followers, view counts, watch hours, and verification).

Monetized creators receive 60% of eligible net advertising revenue generated by their content, as determined by platform tracking.

Revenue calculations, impression validation, and anti-fraud deduplication are performed exclusively by Kahuwa's automated systems.

Payouts are subject to minimum withdrawal thresholds (₹500), identity verification (KYC), and tax compliance.

Violation of Community Guidelines, fraud, or copyright strikes may result in immediate suspension from the monetization program and forfeiture of accrued illegitimate earnings.

5. Virtual Gifts & In-App Purchases

Users may purchase Virtual Coins to send virtual gifts to creators as expressions of appreciation.

Virtual Coins and gifts have no monetary value outside Kahuwa, are non-refundable, non-transferable, and do not constitute personal property.

Creators receive a 60% share of virtual gift values credited to their platform wallet, withdrawable per payout rules.

Kahuwa reserves the right to adjust coin package pricing, gift selections, and conversion parameters with prior notice.

6. Intellectual Property & Copyright Claims

Kahuwa respects the intellectual property rights of others and responds promptly to valid notices of alleged copyright infringement under the Indian Copyright Act and DMCA provisions.

If you believe your copyrighted work has been infringed, submit a notice to [email protected] with proof of ownership, exact video URL, and contact details.

Repeat infringers who accumulate multiple verified copyright strikes will face account termination.

7. Termination & Account Suspension

You may terminate your account at any time by contacting [email protected].

Kahuwa reserves the right to suspend, restrict, or terminate any account, with or without prior notice, for conduct that violates these Terms, harms other users, or creates legal liability.

8. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

Kahuwa does not guarantee uninterrupted, error-free, or secure service operation.

In no event shall Kahuwa, its officers, directors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
